Agreement between User and PartyGo Rentals
Welcome to PartyGo Rentals. The https://partygorentals.com/ website (the “Site”) is operated by PartyGo Rentals (“PGR”). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy for your reference.
PartyGo Rentals is an E-Commerce Site.
PartyGo Rentals uses this website as an informational and e-commerce platform to promote and sell event rental services, including but not limited to chairs, tables, linens, tents, chinaware, flatware, bars, glassware, catering equipment, lighting, dance floors, outdoor equipment, stages, and other tools and equipment needed for residential, commercial, and corporate events and parties.
Privacy
Your use of https://partygorentals.com/ is subject to PGR’s Privacy Policy. Please review our Privacy Policy, which governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting the Site or sending emails to PGR constitutes electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.
Children Under Thirteen
PGR does not knowingly collect personal information from persons under the age of thirteen. If you are under 18, you may use the Site only with permission from a parent or guardian.
Cancellation/Refund Policy
Refunds
All rental fees are final. If equipment is not used (including helium and propane tanks), PGR does not authorize any refund. Once equipment leaves the warehouse, rental time and fees are active. However, PGR will exchange any items that are not functioning properly. Equipment is inspected before leaving the warehouse, in addition staff will also test all items at the event location. If an issue arises, staff will attempt to fix the problem or provide options for a refund or exchange. Arrangements must be made immediately.
Refunds
- 90% of the security deposit will be refunded for cancellations made before 7 days of the delivery or pickup date. A 10% cancellation processing fee applies to orders paid with a credit card.
- A 100% cancellation fee applies to special or customized orders (e.g., balloons, linens, tents, helium, propane) once the order is placed.
- A 100% cancellation fee applies to rental items canceled less than 24 hours before delivery or pickup.
- A 50% cancellation fee applies to items canceled less than 48 hours before delivery or pickup.
No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use the Site in accordance with these Terms. You may not use the Site for any unlawful purpose or in a manner that could damage, disable, or impair the Site.
All content on the Site, including text, graphics, logos, and images, is the property of PGR or its suppliers and is protected by intellectual property laws. You may not modify, publish, transmit, or create derivative works from any content without express written permission from PGR.
International Users
The Site is controlled and operated from the United States. If you access the Site from outside the U.S., you are responsible for compliance with local laws.
Indemnification
You agree to indemnify and hold harmless PGR, its officers, directors, employees, and agents from any claims arising out of your use of the Site, violation of these Terms, or infringement of any third-party rights.
Arbitration
Any disputes arising from these Terms will be resolved through binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association. The arbitration will take place in Los Angeles, California, and the arbitrator’s decision will be final.
Class Action Waiver
Arbitration will be conducted on an individual basis. Class arbitrations and class actions are not permitted.
Liability Disclaimer
The Site and its content are provided “as is” without warranties of any kind. PGR disclaims all liability for damages arising from your use of the Site, including but not limited to direct, indirect, incidental, or consequential damages.
Termination/Access Restriction
PGR reserves the right to terminate your access to the Site at any time without notice. This agreement is governed by California law, and you consent to the exclusive jurisdiction of California courts.
Changes to Terms
PGR reserves the right to modify these Terms at any time. The most current version will supersede all previous versions.
